FitKobra Terms of Service

🚨 MEDICAL DISCLAIMER & EMERGENCY ACTION NOTICE

FitKobra is strictly a fitness, conditioning, and athletic wellness application. It is NOT a certified Medical Device (SaMD) and does NOT provide clinical diagnosis or medical treatment. If you experience chest pain, sudden numbness, acute hypertension (>180/>120 mmHg), or respiratory distress, immediately contact emergency services (911, 112, 000, 999).

1. Acceptance of Terms

By registering, accessing, downloading, or using FitKobra, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you must not use the application.

2. Age Requirement & Eligibility (18+ Requirement)

FitKobra is strictly restricted to individuals who are at least eighteen (18) years of age. By creating an account or using the platform, you represent and warrant that you are at least 18 years old and possess the legal capacity to enter into these Terms.

3. Medical Disclaimer & Assumption of Athletic Risk

FitKobra, its AI Coach Maya, 3D kinematic form trackers, and cardiovascular wellness tools (Tactile Pulse Cadence Rhythm Checker and Blood Pressure Logger) are provided strictly for educational and athletic conditioning purposes. FitKobra does not use optical camera sensors for vitals acquisition.

Always consult a qualified medical physician before beginning any new athletic training, caloric deficit, or nutritional regimen. Use of FitKobra is solely at your own risk.

4. User Account & Credential Security

You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at fitkobra.ai@gmail.com if you suspect any unauthorized access to your account.

5. Global Leaderboard & Competitive Community Features

Authenticated users may participate in the Global Streak & Points Leaderboard. Only your display name, optional profile picture, accumulated activity points, and streak counts are visible to other users. No sensitive health data (weight, height, date of birth, vitals, or email) is ever made public.

You may opt out of the leaderboard at any time by deleting your account via Profile Settings or by emailing fitkobra.ai@gmail.com.

6. User Rights, Data Portability & Hard Deletion

In accordance with the DPDP Act 2023 and GDPR, you maintain absolute ownership over your fitness and personal data. You may export your entire data archive in JSON format or trigger a permanent hard erasure (purging all vitals, meals, workouts, and account credentials) directly in the app settings.

7. Limitation of Liability

To the maximum extent permitted by applicable law, FitKobra Technologies Inc., its founders, developers, and partners shall not be held liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the platform, including athletic injury, health complications, or device malfunctions.
